Booking terms and house rules

§1General
These terms govern bookings and stays at D-Apartments and form part of the agreement between the Host and the Guest.

- Apartment — a flat let for short stays.
- Booking — a confirmed and paid agreement for specific dates.
- Making a booking means accepting these terms.
§2The apartments
- Four apartments at ul. Lubomirskiego 11 in Kraków, each for up to 4 guests.
- The apartments are let for short stays only. The letting does not serve permanent housing needs and is not covered by Polish tenant-protection law.
- The number of people staying may not exceed the number stated in the booking.
§3Making a booking
- Bookings are made through the form at dapartments.eu.
- Once the form is submitted, the selected dates are held for 35 minutes so that payment can be completed. If payment is not made within that time, the dates are released automatically and the booking expires.
- The agreement is concluded when payment is received. Confirmation is sent to the e-mail address given during booking.
- A booking arriving on the same day requires additional confirmation from the Host, as the time available to prepare the apartment is limited. If the Guest cannot be accommodated, the full amount is refunded immediately.
- The Guest is responsible for the accuracy of the details provided, in particular the e-mail address used for the confirmation and the invoice.
§4Prices and payment
- All prices are gross and include 8% Polish VAT.
- The price covers accommodation for two guests, utilities, bed linen, towels and the final cleaning.
- Extra charges are one-off for the whole stay, not per night:

- Availability of early check-in and late check-out depends on the bookings adjacent to the Guest’s stay and on the time needed for cleaning. Available hours are shown in the booking form before payment.
- Payments are processed by Stripe Payments Europe Ltd. Available methods: BLIK, Przelewy24, payment card, Apple Pay, Google Pay. The Host has no access to the Guest’s card details.
- Settlement is possible in Polish zloty, euro or US dollars. Prices in foreign currencies are converted at the mid rate of the National Bank of Poland plus 3%. The binding amount is the one shown in the chosen currency before payment.
- A promo code is reflected in the price shown before payment. Discounts do not combine — the one more favourable to the Guest applies.
§5Invoices
- An invoice is issued for every paid booking and sent to the e-mail address given during booking.
- For a company invoice, tick the relevant box in the form and provide the VAT ID and company details before making the payment.
- Invoices for entities with a Polish NIP are submitted to the National e-Invoice System (KSeF) as required by law.
- Refunds are documented by a corrective invoice.
§6Cancellation and refunds
When booking, the Guest chooses one of two rates. The chosen rate applies for the whole booking and cannot be changed afterwards.

- Cancellation is done by the Guest through the link in the booking confirmation. The refund amount is shown before the cancellation is confirmed.
- The number of days before arrival is counted in calendar days.
- Refunds are returned using the original payment method. Funds usually arrive within 5–10 business days, depending on the Guest’s bank.
- If the stay cannot take place for reasons on the Host’s side, the full amount is refunded regardless of the rate chosen.
- Leaving earlier than planned does not entitle the Guest to a refund for unused nights.
Right of withdrawal. Under Article 38(12) of the Polish Consumer Rights Act, the right to withdraw from a distance contract does not apply to contracts for accommodation services other than for residential purposes where the contract specifies the date or period of performance. A booking for specific dates is such a contract. The cancellation rules above are contractual and more favourable than the statutory position.
§7Arrival and departure
- Check-in from 15:00 on the day of arrival, check-out until 10:00 on the day of departure.
- Check-in is self-service. Access instructions are sent before arrival to the e-mail address given during booking.
- The Host may ask the person who made the booking to present an identity document.
- Early check-in and late check-out are available only if paid in advance and only at the hours confirmed during booking.
- Leaving belongings in the apartment after check-out time without prior agreement is treated as extending the stay by another night and is charged at the current rate.
§8House rules
- Smoking is prohibited throughout the apartment, including e-cigarettes. Breaching this rule means being charged for ozone treatment and laundering of textiles.
- Quiet hours are 22:00–6:00. Parties and events are not allowed.
- The number of people staying overnight may not exceed the number stated in the booking. Overnight visitors require the Host’s consent.
- Pets require prior agreement with the Host.
- The Guest shall use the apartment as intended and respect the building rules and the neighbours.
- When leaving, please close the windows and doors and leave the keys as agreed.
§9Liability
- The Guest is liable for damage caused by them or by their visitors, including damage to or loss of furnishings.
- Any damage should be reported to the Host without delay.
- To the extent permitted by law, the Host is not liable for items left behind after the stay, nor for loss of or damage to items brought in by the Guest.
- The Host is not liable for inconveniences caused by circumstances beyond its control, such as interruptions in utilities or renovation work carried out by the building community.
§10Complaints
- Complaints should be sent to contact@dapartments.eu. Issues with the apartment are best reported during the stay, so that they can be fixed on the spot.
- Complaints are answered within 14 days of receipt, by reply to the address they were sent from.
- A Guest who is a consumer may use out-of-court complaint and redress procedures, in particular by contacting the voivodeship inspector of the Trade Inspection or the municipal or district consumer ombudsman.
§11Personal data
- The data controller is D-APARTMENTS Sp. z o.o., seated in Kraków.
- Data is processed to handle the booking, settle the payment, issue the invoice and contact the Guest.
- Details are set out in the Privacy policy.
§12Final provisions
- Matters not covered here are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
- The Host may amend these terms. Bookings already paid for are governed by the version in force on the day the booking was made.
- These terms are in force since 1 September 2026.
